Policy of Electronic Communications

Whereas in consideration for the use use of services, you hereby agree to this Policy of Electronic Communications (herein “Electronic Communications”). Therefore, you as the “User” hereby agrees to the binding terms and conditions as follows:
Section 1: Delivery of Communications; Use of Electronic Signatures
Under this policy with your consent, Colletti Tech LLC (herein “Colletti Tech”) shall have all rights to issue communications electronically via the SMS, MMS, iMessage, email, websites, applications and such electronic platforms as they may exist from time-to-time. Communications hereinafter shall include, however not limited to:
(a) Agreements, policies, forms, notices and like legal documents;
(b) Payments, transactions, authorizations, renewals, receipts or confirmations;
(c) Account statements, notices or history; and
(d) Tax statements, documents and forms.
Section 2: Obligations of User
Upon use of the Electronic Communications service, you are responsible for maintaining the confidentiality of your user account, credentials, and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You shall not assign or otherwise transfer your account to any other person or entity. You acknowledge that Colletti Tech is not responsible for third party access to your account that results from theft or misappropriation of your account. All rights shall be reserved to refuse, cancel, suspend, and terminate consent, which shall include, however not limited to, modification of the terms of this consent at our sole discretion.
Section 3: Requirements for Access
Whereas necessity to participate in the Electronic Communication services, the device should adhere to the following hardware and software. Herein, the minimum requires to achieve access shall include:
(a) Broadband connection from a Internet Service Provider, utilizing the appropriate hardware;
(b) Device that is not utilizing a Proxy or VPN tunnel;
(c) Email service utilizing POP3, SMTP, or IMAP to receive receipts of communication and signed documents;
(d) Internet Browser with latest encryption, cookies, cache, and like services enabled; and
(e) Operating System that is not at the end-of-life or end-of-support, with all current or relevant patches, updates, service packs or similar.
Upon the failure of the end user to achieve said minimum requirements for such electronic communications and signature, it may result in the inability to use this service. Furthermore, any inability to use this service shall imply the withdrawal of consent.
Section 4: Withdrawal of Consent
Whereof a written notice submitted to Colletti Tech, you may elect to withdraw your consent of electronic-signature authorization. Additionally, the user may withdraw their consent of electronic communications at any time. However, such withdrawal may result in cancellation of your account with Colletti Tech. Any withdrawal of your consent will be effective after a reasonable period for processing the request to withdraw consent.
