Consent to E-SIGN

In consideration for services provided, to a “User”, who willfully and voluntarily enters into with Colletti Tech LLC, herein the “Service Provider”, this Consent to E-SIGN; hereinafter “E-SIGN Consent”, “E-Sign Service”, “E-SIGN” and “Consent”. The definition of a “User”, for this consent, shall hereinafter be all “Persons”, “Entities”, “Customers”, “Employees” and “Members” with or without an account. This domain (“Colletti-Tech.com”), website (the “Site”), provided products (a “Product”) and rendered services (the “Services”) is comprised of various web pages and services operated or offered by Colletti Tech LLC (“Colletti Tech”). The use of the domain, website, a product or collective services is offered to you conditioned on your acceptance without modification of the terms, conditions, policies, notices and legal regulations contained herein (the “Terms and Conditions”). Your use of domain, website, products and services constitutes your agreement to all such Terms and Conditions. Under this Agreement, the “User” agrees to the binding terms and conditions as follows:
Section 1: Delivery of Communications; Use of Electronic Signatures
Under this Consent, Colletti Tech LLC shall have all rights to issue communications electronically via the domain, email, text message, websites or applications. Communications hereinafter shall include, but are not limited to:
(b) Payment authorizations, payment method-on-file and transaction receipts or confirmations;
(c) Account statements, relationship and history; and
(d) Federal, State and Local tax statements, documents and forms.
Section 2: Obligations of User
Upon use of the E-SIGN Consent service, you are responsible for maintaining the confidentiality of your user account, credentials, herein account and password, and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You shall not assign or otherwise transfer your account to any other person or entity. You acknowledge that Colletti Tech LLC is not responsible for third party access to your account that results from theft or misappropriation of your account. All rights shall be reserve to refuse, cancel, suspend and terminate services relation to or the entire account relationship; including such rights to remove or edit content in our sole discretion. Upon necessity, Colletti Tech LLC may require any User, all known persons and entities, to provide valid identification pursuant to Terms of Service of Colletti Tech.
Section 3: Requirements for Access
Where as a necessity to participate in the E-SIGN Consent service, the Device, Workstation or Server should adhere to the following hardware and software. Herein, the minimum requires to achieve access shall include:
(a) Broadband Connection from a Internet Service Provider, utilizing Multi-Mode Fiber or DOCSYS 3.0 with the appropriate networking devices;
(b) System that is not utilizing a Proxy or VPN configuration, client, server or gateway;
(c) Email Account utilizing POP3, SMTP and IMAP, to receive receipts of communication and signed documents;
(d) Internet Web Browser with 256-Bit encryption standards and Cookies, Cache, Temporary and License Data Services enabled;
(e) Installation of a Web Browser:
(i) Apple Safari;
(ii) Google Chrome;
(iii) Microsoft Edge;
(iv) Linux Distro;
(f) Operating System that is not at the End of Life, with all current or relevant patches, updates, service packs or similar:
(i) Apple macOS;
(ii) Google ChromeOS;
(iii) Microsoft Windows;
(iv) Linux Distro;
(v) Unix Distro.
Upon any event that a Device, Workstation or Server fails to achieve the minimum requirements, it may result in the inability to use this service or Termination and Withdrawal of Consent.
Section 4: Withdrawal of Consent
Hereof a written notice submitted to Colletti Tech LLC, the User may elect to withdraw their consent of receiving electronic communications at any time. However, such withdrawal of your consent to receive electronic communications may result in Termination for Cause of your Account, Products and Services. Any withdrawal of your consent will be effective after a reasonable period of time for processing your request.
Documents, Forms or Records electronically-signed then dated pursuant to the E-SIGN Act of the United States of America, codified as statute 15 U.S.C. § 7001, shall be admissible in Federal, State and Local jurisdictions for administrative and judicial proceedings based upon or relating to this agreement. Whereas subject to the same conditions and extent as any binding documents and records originally generated, maintained in printed form and affixed with a handwritten signature. All agreements, communications, documents, records or any related documents shall be transmitted and written in the Language of English.
